Terms and Conditions of Sale and Use

1. Introduction

These Terms and Conditions (“Terms”) govern access to and use of this website (the “Website”) and all purchases made through it. The Website is operated by SAL Ocean Lifestyle, S.L. (“SAL”, “we”, “us”, “our”).

By accessing the Website or placing an order, you agree to be bound by these Terms. Please read them carefully before using the Website or making a purchase.

3. Scope and Definitions

For the purposes of these Terms:

  • Customer: any individual acting as a consumer who purchases Products via the Website.

  • Products: all garments and accessories offered for sale by SAL.

  • Working days: Monday to Friday, excluding Spanish public holidays.

4. Acceptance of Terms

Use of the Website and completion of an order constitute full acceptance of these Terms and all related policies, including the Privacy Policy, Shipping Policy, and Return & Exchange Policy.

SAL reserves the right to modify these Terms at any time. Changes will apply only to orders placed after the updated Terms are published on the Website.

5. Orders and Contract Formation

Orders may only be placed through the Website.

After placing an order, the Customer will receive an order confirmation email acknowledging receipt. This confirmation does not constitute acceptance of the order.

A binding sales contract is formed only when SAL confirms dispatch of the Products by email.

SAL reserves the right to refuse or cancel an order in cases of product unavailability, payment authorization failure, pricing errors, or reasonable suspicion of fraud or misuse.

6. Prices and Payment

All prices are displayed in euros (€) and include applicable VAT, unless otherwise stated.

Accepted payment methods may include:

  • Credit and debit cards

  • PayPal

  • Apple Pay

  • Google Pay

Payment is processed securely through third-party providers. SAL does not store full payment card details and is not responsible for fees or charges imposed by payment service providers.

7. Shipping and Delivery

Orders are shipped from Barcelona, Spain, to destinations within the European Union, the United Kingdom, and Switzerland.

Estimated delivery times and shipping costs are displayed at checkout and further detailed in the Shipping Policy.

SAL is not responsible for delays caused by customs procedures, force majeure events, or circumstances beyond its reasonable control.

Risk and title pass to the Customer upon confirmed delivery of the Products.

8. Right of Withdrawal and Returns

Customers have the statutory right to withdraw from the purchase within 14 days of delivery, in accordance with applicable EU and UK consumer protection laws.

Additional return and exchange conditions, including extended return windows and eligibility requirements, are set out in the Return & Exchange Policy, which forms an integral part of these Terms.

9. Product Information

SAL makes every effort to ensure that product descriptions, images, and specifications are accurate.

However, slight variations in color, texture, or appearance may occur due to material characteristics or differences in screen displays. Such variations do not constitute defects.

10. Limitation of Liability

To the fullest extent permitted by law, SAL shall not be liable for indirect, incidental, or consequential damages arising from the use of the Website or the purchase of Products.

SAL’s total liability in all cases shall be limited to the amount paid by the Customer for the relevant Product.

Nothing in these Terms limits or excludes liability for fraud, willful misconduct, or death or personal injury caused by negligence.

11. Intellectual Property

All intellectual property rights in the Website and its content are owned by SAL Ocean Lifestyle, S.L. or its licensors.

No content may be copied, reproduced, distributed, or used without prior written consent from SAL.

12. Privacy and Data Protection

Personal data are processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

13. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Spain.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain, without prejudice to mandatory consumer protection rights in the Customer’s country of residence.
